Terms and Conditions
The terms that apply to enquiries, assessments, program enrolment and use of this website.
1. Acceptance of these terms
By using this website, submitting an enquiry, or enrolling a player in an iTUSA program, you agree to these terms. If the player is under 18, you confirm that you are their parent or legal guardian and that you accept these terms on their behalf. Where these terms give a right or place an obligation on “you”, it is the parent or legal guardian who holds it.
2. Who we are, and what these terms cover
The programs described on this website are provided by PATRIMONIOS RFM 2024, S.L. (“iTUSA”), a company incorporated in Spain, tax identification number (NIF) B75317479, registered office Paseo Reina Sofía nº 3, Planta 1, Pta. 12, 03780 Pego (Alicante), España.
That address identifies the company. It is not where the programs run: coaching is delivered at the academy’s facilities in Hospitalet de l’Infant, Tarragona, and remotely.
These terms cover the use of this website and the player development programs — Full Board Elite Junior, Remote Elite Junior, assessment clinics and professional training blocks — together with the technology used to deliver them, including the iTUSA app and the Parent Dashboard.
They do not cover the iTUSA coach certification internship or the professional pathway that follows it. Those are agreed separately and in writing with each selected candidate, under their own terms. Program availability, intake dates and places are limited and subject to assessment.
3. Enquiries and assessment
Submitting the Contact form does not guarantee a place in any program. Admission depends on assessment, commitment, family alignment and places available, as described on the Programs and Contact pages. We aim to respond to every enquiry promptly.
4. Enrolment, fees and payment
Fees, payment schedules and accepted payment methods are confirmed to you in writing before enrolment is finalised, in the enrolment agreement. Nothing is due before you have received them. They are not published on this website because places are allocated by assessment rather than sold from a price list.
Programs run in six-week development cycles. A full-board place is not an open-ended enrolment: it is reviewed every two cycles, together with the family, on commitment and progression, as set out in the enrolment agreement. Where an on-site week is credited against a program fee — for example after a Selection Week — the credit terms are stated in writing in the enrolment agreement.
As a general principle, fees cover the coaching, assessment and platform access described for the relevant program. They exclude travel, accommodation outside the Full Board program, equipment, insurance and personal expenses, unless stated otherwise in writing.
5. Your right to withdraw, and cancellations
If you enrol a player without meeting us in person — through this website, by email or by telephone — you are entering a distance contract. As a consumer you have 14 days from the day the contract is concluded to withdraw from it, without giving a reason and without penalty, under Spanish consumer law (Real Decreto Legislativo 1/2007). Write to contact@itusa.es within that period and we will refund what you have paid within 14 days of receiving your notice.
If you ask us in writing to begin the program during those 14 days and then withdraw, we may retain an amount proportionate to what has already been delivered.
iTUSA grants the 14-day right of withdrawal in all cases, including programs booked for specific dates.
After the withdrawal period, notice periods, refund schedules and the treatment of deposits are those set out in your enrolment agreement, which you receive and accept before any payment is due.
iTUSA may adjust schedules, coaching staff or program format where reasonably necessary, and will give families as much notice as possible. Where iTUSA cancels a confirmed place itself, fees paid for the cancelled portion are refunded in full.
6. Player conduct and supervision
Players and families are expected to follow the coaching team’s guidance on training, conduct and safety, on and off court. For full board players, the supervision arrangements — including who is responsible for the players outside training hours, and the name and direct contact of the person to raise any concern about a player’s welfare with — are set out in the enrolment documents and given to every family before arrival.
iTUSA may suspend or end a player’s participation where conduct puts that player, other players or staff at risk. This is a last resort, the family is involved before any decision is taken, and the financial consequences are those set out in the enrolment agreement.
7. Insurance and medical care
iTUSA holds civil liability insurance covering its coaching activity and the reception of players at the academy. A certificate is available to enrolled families on request.
That cover does not replace personal insurance. Every player must hold private health insurance valid in Spain for the full duration of their program, including repatriation. Proof is required before arrival; a player who cannot provide it cannot begin the program. Travel and cancellation insurance are strongly recommended and remain the family’s decision.
Because full board players are minors living away from their parents, the enrolment documents include a written medical authorisation, by which the parent or legal guardian authorises iTUSA to obtain medical care for the player in an emergency where the parent cannot be reached in time. iTUSA contacts the family at the earliest opportunity in every such case.
8. Intellectual property, filming and image rights
The iTUSA methodology, training materials, platform content and site content are the property of iTUSA and its licensors, and may not be copied, redistributed or used to build a competing service without written permission.
Training sessions are routinely filmed for development purposes: video analysis is part of the methodology, and that footage forms part of the player’s file, accessible to the player, the family and the coaching team. Promotional use of a player’s image — on this website, on social media or in advertising — happens only with the prior written consent of the parent or guardian, given in the enrolment agreement or separately. Consent can be withdrawn at any time by writing to contact@itusa.es; withdrawal stops future use and, where reasonably possible, removes existing material.
9. Limitation of liability
Tennis is a physical activity that carries an inherent risk of injury, and full board participants take part in a residential program away from home. iTUSA maintains the insurance described in section 7 and applies the supervision arrangements described in section 6.
To the extent permitted by Spanish law, iTUSA’s total liability arising out of or in connection with a program is limited to the fees paid for that program in the twelve months preceding the claim. Nothing in these terms limits liability that cannot be excluded under applicable law — including death or personal injury caused by negligence, and fraud.
10. Website use
This website is provided for informational and enquiry purposes. We do not guarantee that it will be uninterrupted or error-free, and content may be updated without notice.
11. Governing law
These terms are governed by the laws of Spain, without regard to conflict-of-law principles. Any dispute will be subject to the exclusive jurisdiction of the courts of Tarragona, without prejudice to any mandatory consumer-protection venue rights a family may have under applicable law.
12. Changes to these terms
We may update these terms as the site or the programs change. Continued use of the site, or an active enrolment continuing after an update, constitutes acceptance of the revised terms. Changes that affect an enrolment already under way are notified to the family directly.
13. Contact
Questions about these terms can be sent through the Contact page or to contact@itusa.es, or by post to PATRIMONIOS RFM 2024, S.L., Paseo Reina Sofía nº 3, Planta 1, Pta. 12, 03780 Pego (Alicante), España. How your personal data is handled is set out in our Privacy Policy.
